Photographer’s Agreement

Photographs and the story with them form a unique and important source, preserving memories and information which might otherwise be lost. Dorset History Centre and Bridport Museum wish to add to their collections photographs and the associated stories which reflect the impact of the current Covid-19 pandemic in Dorset. Such records might be used by future researchers, Dorset History Centre, and Bridport Museum in a number of ways, including:

  • Being made available to researchers visiting the History Centre, Bridport Museum, or being made available to researchers online.

  • Being used in talks, workshops, exhibitions or performances at the History Centre or Bridport Museum.

  • Use on the web or in the media (usually extracts) to promote, and raise awareness of, their collections.

  • In order to make effective use of these photographs and stories, we need participants to agree to the terms below. We are asking that you grant a licence for the use of your photos and accompanying words so that it is not necessary to contact you each time we want to make use of the photographs or the associated stories. Given the number of submissions and the potential difficulties in contacting you which may arise with the passing of time this would make the management of the archive, particularly in the longer term, incredibly difficult. So we are asking you to tick the “agree to terms and conditions” box on the submission form in order to grant that licence to the Dorset History Centre, Bridport Museum and the Bridport Lockdown Project.

  • This is very similar to what happens when photos are entered into competitions. It does not mean that we are going to sell your photos or start claiming that they were taken by someone else. If your photos are used in any merchandising or book related to the project then any profits from that would either go towards covering the running costs of the project or be passed on to local charities or similar organisations who we support as our partners.

Your name and contact details are collected solely for the purpose of administration and collections / rights management by the Dorset History Centre, Bridport Museum, and the Bridport Lockdown Project – it will not be shared with third parties or used for any other purpose. You email address will be added to our mailing list but you have the option to unsubscribe from this at any time either by contacting us via email or by clicking the unsubscribe button at the bottom of our newsletters.

By agreeing to the Terms and Conditions you confirm that the photos and words which you submit (your Submission) document the impact of Covid-19 in Dorset, are your own original work, have been taken with the permission of the subject, are not defamatory, and that there are no conflicting agreements in place that restrict usage of your Submission. You also confirm that you are the sole owner of the copyright in your Submission and hereby grant to the Bridport Lockdown Project, Bridport Museum, Dorset History Centre and its parent organisation (Dorset Council and its successors) (The Project and Partners)  a non-exclusive, multiple use, irrevocable, royalty free, un-ending, world-wide, non-commercial licence to publish, communicate to the public and use your Submission in all and any media, in any context and at any time, including without limitation on the websites and social media channels of the Bridport Lockdown Project, Dorset History Centre, and Bridport Museum. You understand that you will retain copyright and that this will not affect your moral right to be identified as the ‘artist’ in accordance with the Copyright, Design and Patents Act 1988. You also agree that, if your photograph includes an image of any person under the age of 16 at the time of the photograph being taken, you have the consent of the parent or legal guardian of that person to share this image. You also agree that The Project and Partners reserve the right to edit, crop, or adjust your Submission responsibly and fairly without notifying you and you agree to waive any and all rights to object to such actions undertaken by Us in respect of your Submission.

If you would like restrictions on public access for a set period, or if you would like to exclude certain uses as described overleaf, please contact us by email (submissions@bridportlockdown.org). You will be contacted by the Bridport Lockdown Project to clarify your intent in this.

The Bridport Lockdown Project supports the Bridport Rights Respecting Town Charter to be fair, safe and kind. We will accept all submissions but reserve the right to refrain from sharing photos or text which we consider to be offensive or hateful. Degrading comments about things such as race, religion, culture, sexual orientation, gender or identity will not be tolerated. We encourage honesty and openness. Although it is tricky not to include politics in a project based around the restrictions imposed on our lives by an elected government, this project is neutral as far as party politics go and we would ask contributors to respect that.

This Agreement will be governed by and construed in accordance with English law and the jurisdiction of the English courts. Both parties shall, by your agreement to the Terms and Conditions, indicate acceptance of the Agreement.
